Cannabis and hemp product liability: submission checklist

A retail-agent guide to preparing cannabis and hemp product-liability submissions for cultivation, processing, distribution, dispensary and delivery operations.

Cannabis and hemp accounts need an operations-specific submission. A cultivation facility, an edible manufacturer, a distributor, a dispensary and a delivery-only operation can all have product exposure, but they do not present the same insurance questions.

Start with the exact cannabis or hemp product and operation. Say whether the insured cultivates, processes, extracts, manufactures, distributes, sells, delivers or supports the product. Identify the operating state, license category, product route and whether the product is inhaled, ingested, topical or otherwise used. That detail helps separate products liability from general liability, commercial property, cargo, commercial auto and professional-service questions.

The FDA’s cannabis and cannabis-derived product overview explains why a product’s ingredients, intended use and marketing claims should be clear before it is characterized as food, a dietary supplement, a drug or another regulated product.

Coverage questions to separate

ExposureWhat the submission should clarify
Products liabilityProduct type, ingredients, intended use, labels, sales channel, distribution territory and quality controls
Premises liabilityWhether there is cultivation, processing, retail, on-site consumption, events or public access
Property and equipmentLocation, stock, extraction or processing equipment, business personal property and catastrophe exposure
Delivery and transitOwnership of vehicles, driver arrangement, routes, goods in transit and contract responsibility
Professional servicesConsulting, medical, compliance, laboratory or other services that may need a separate review
RecallBatch traceability, complaints, testing, supplier controls, recall plan and notices

The requested line, form, state and operations answer different questions. A single “cannabis insurance” label leaves those questions open.

Cannabis and hemp submission checklist

Cannabis and hemp forms vary with the product, state and requested coverage. An ideal submission package includes the supplemental form, loss explanations, declarations, product menu or ingredients and website. Sending those materials together gives us the clearest starting point for review.

  • Completed standard application(s) and the cannabis or hemp supplemental form.
  • Exact entity, operating state or states, license category and locations.
  • A plain-English description of cultivation, processing, extraction, manufacturing, distribution, dispensary, retail, delivery and ancillary activities.
  • Product menu, catalog, labels, ingredients, route of use and website or product pages.
  • Annual revenue by operation and product category, sales territory, customer type and distribution channel.
  • Supplier, contract-manufacturing, testing, quality-control, traceability, storage and complaint-handling procedures.
  • Five years of currently valued loss runs and an explanation for every known loss, complaint, claim or recall event.
  • Current and expiring declarations, prior-insurance information and retroactive dates for claims-made coverage.
  • Requested lines, limits, deductibles, effective date and any vendor, landlord, licensor or contract insurance requirements.
  • Property, equipment, inventory, cargo, vehicle or delivery schedules when those lines are requested.

Product claims change the conversation

Explain what the product says it does and where that statement appears. A product label, website, menu or sales material gives more detail than a broad description such as “CBD retailer” or “cannabis manufacturer.” A label alone does not settle medical, regulatory or coverage questions. Include it in the submission package for review.

Submit the cannabis or hemp material you have. We review the operation, state footprint, product claims and requested coverage, then identify anything else needed before approaching the market. For the cross-industry checklist, see product liability for manufacturers, importers and distributors. The checklist prepares an account for review; it is not a statement of availability or coverage.

Short answers.

What should a cannabis product-liability submission include?

Send the cannabis supplemental application, operations narrative, product menu or ingredients, website, current or expiring declarations and an explanation for every loss. Add state, license, distribution and delivery details that explain the actual operation.

Does product liability cover the whole cannabis operation?

No. Product liability does not by itself establish coverage for premises, property, commercial auto, professional services, cargo or another part of the operation. Each requested line needs its own review.

Are cannabis and hemp submitted the same way?

No. The actual product, ingredients, route of use, state, license, operations and coverage request determine the useful submission route. Do not treat a hemp or CBD product as automatically equivalent to a cannabis account.
